1. Who We Are

Q Crowd is a crowd-sourced theme park queue and crowd intelligence service.

In these Terms, "Q Crowd", "we", "us", and "our" means Mr M K Butler, trading as Q Crowd. "You" means the person using the Q Crowd app, website, APIs, or related services.

2. What These Terms Cover

These Terms apply when you create an account, use Q Crowd, submit queue or crowd reports, use location-based features, view wait-time estimates, or interact with related Q Crowd services.

You should also read our Privacy Notice. The Privacy Notice explains how we collect, use, store, share, and protect personal data, including location data.

If you do not agree to these Terms, do not create an account or use Q Crowd.

3. Eligibility

You must be at least 16 years old to create an account and use Q Crowd on your own.

If you are under 16, or if the law where you live requires parent or guardian consent for online services, you may use Q Crowd only with permission and supervision from your parent or legal guardian. The parent or guardian is responsible for your use of Q Crowd.

You must not use Q Crowd if you are barred from doing so under applicable law.

4. Your Account

You are responsible for keeping your account sign-in details secure and for activity that occurs under your account.

You must provide accurate information when creating or using an account. You must not impersonate another person, create accounts for abusive purposes, or attempt to bypass account, location, trust, safety, or rate-limit controls.

Tell us promptly if you believe your account has been accessed without permission.

5. What Q Crowd Does

Q Crowd allows users to:

  • select or confirm a theme park visit;
  • submit queue start, boarding, ride completion, queue exit, and crowd reports;
  • use device location to help validate in-park and ride-area signals;
  • view Q Crowd estimates based on user reports;
  • view third-party posted wait times or operating status where we choose to show them;
  • receive prompts, live activity updates, or similar app surfaces that help record queue and ride events.

Q Crowd is an informational tool only. It does not sell park admission, reserve ride access, guarantee entry, provide official park information, or replace information from the park operator.

6. Location Features

Some Q Crowd features use location data to decide whether you appear to be in a park, near a ride, in a queue area, on a ride, or leaving an area.

Location data can be inaccurate, delayed, unavailable indoors, affected by poor signal, or affected by device settings. Q Crowd may therefore ask you to confirm, correct, or dismiss a prompt.

You can control app location permissions through your device settings. Some features may not work, or may be less accurate, if location permissions are disabled or limited.

7. Queue, Ride, And Crowd Information

Q Crowd estimates are based on available reports, device signals, timing data, and other information. Estimates may be incomplete, delayed, stale, inaccurate, or unavailable.

If Q Crowd displays a third-party posted wait time or operating status, that information comes from an external source and may not match Q Crowd's observed user reports or the actual time you wait. We may show when the third-party value was refreshed, and we may mark a value as stale or unavailable.

Q Crowd does not guarantee that any queue time, ride status, crowd level, route, prompt, notification, or recommendation is accurate or current.

You remain responsible for checking official park information, posted signs, staff instructions, safety rules, opening times, ride restrictions, weather conditions, and your own judgement.

8. Safety

Do not use Q Crowd in a way that distracts you from your surroundings or park safety instructions.

Do not use Q Crowd while operating a vehicle, while boarding or exiting a ride when doing so would be unsafe, or anywhere device use is prohibited.

Always follow instructions from park staff and emergency services. Official park safety instructions override anything shown in Q Crowd.

9. User Reports And Content

When you submit queue, ride, crowd, correction, or other reports, you must make reasonable efforts to be accurate and honest.

You must not submit false, misleading, abusive, unlawful, automated, spam, or malicious reports. You must not attempt to manipulate estimates, damage service quality, overload the service, or interfere with other users.

By submitting reports or other content to Q Crowd, you grant us a worldwide, non-exclusive, royalty-free licence to use, host, process, analyse, display, reproduce, modify, and create aggregated or derived information from that content for operating, improving, securing, and promoting Q Crowd. This licence continues for as long as needed for those purposes, subject to applicable law and our Privacy Notice.

10. Acceptable Use

You must not:

  • reverse engineer, scrape, overload, attack, or interfere with Q Crowd;
  • access or attempt to access another user's account or data;
  • bypass security, trust, location, rate-limit, or anti-abuse controls;
  • use Q Crowd for unlawful, harmful, fraudulent, or abusive purposes;
  • copy, resell, or commercially exploit Q Crowd data without our written permission;
  • use Q Crowd in a way that infringes another person's rights.

11. Third-Party Services And Park Operators

Q Crowd may use, link to, or display information from third-party services, data feeds, platforms, app stores, device operating systems, maps, notification services, analytics, hosting providers, or theme park-related sources.

Those third-party services are governed by their own terms and policies. We are not responsible for third-party services, their availability, their data, or changes they make.

Q Crowd is independent and is not affiliated with, endorsed by, sponsored by, or approved by Walt Disney Parks and Resorts, Universal, SeaWorld, Merlin Entertainments, or any other park operator unless we expressly say otherwise. Park and ride names may be used only to identify locations and attractions.

12. Changes To Q Crowd

We may change, suspend, limit, or stop any part of Q Crowd at any time. Features may be experimental, unavailable, or changed without notice.

We may update these Terms from time to time. If a change is material, we will take reasonable steps to notify you, such as showing the updated Terms in the app or requiring renewed acceptance.

13. Suspension And Termination

We may suspend or terminate your access if we reasonably believe that you have breached these Terms, created risk for Q Crowd or other users, submitted abusive or misleading reports, or used the service unlawfully.

You may stop using Q Crowd at any time. Account deletion and data rights are handled as described in our Privacy Notice and applicable law.

14. Intellectual Property

Q Crowd, including its software, design, branding, logos, text, data structures, and service outputs, is owned by us or our licensors and is protected by intellectual property laws.

These Terms do not transfer ownership of Q Crowd or our intellectual property to you. We grant you a limited, revocable, non-transferable, non-exclusive right to use Q Crowd for personal, non-commercial park visit planning and reporting, subject to these Terms.

15. No Warranties

Q Crowd is provided "as is" and "as available".

To the fullest extent permitted by law, we do not promise that Q Crowd will be uninterrupted, error-free, secure, accurate, current, or available at any particular time or place.

Nothing in these Terms limits rights that cannot legally be limited, including consumer rights that apply in your country or state.

16. Limitation Of Liability

To the fullest extent permitted by law, we are not liable for indirect, incidental, special, consequential, exemplary, or punitive losses, or for loss of profits, revenue, goodwill, data, use, or opportunity.

To the fullest extent permitted by law, our total liability relating to Q Crowd or these Terms is limited to the greater of: (a) the amount you paid us to use Q Crowd in the 12 months before the event giving rise to the claim; or (b) GBP 100, EUR 120, or USD 125, depending on the currency most closely connected to your claim.

Nothing in these Terms excludes or limits liability where it would be unlawful to do so, including liability for death or personal injury caused by negligence, fraud, fraudulent misrepresentation, or statutory rights that cannot be excluded.

17. Consumer Rights

If you are a consumer in the UK, EEA, EU, or another jurisdiction with mandatory consumer protection laws, you may have legal rights that cannot be excluded or limited by these Terms. These Terms apply only to the extent allowed by those laws.

18. Governing Law And Disputes

These Terms are governed by the laws of England and Wales, except where mandatory consumer laws in your country or state require otherwise.

Courts located in England and Wales will have non-exclusive jurisdiction, except where mandatory consumer laws give you the right to bring claims in your local courts.
